Terms of Service

These Terms of Service (“Terms”) govern your access to and use of powerwyze.com and any products or services provided by PowerWyze LLC (“PowerWyze,” “we,” “us”). By using our website, submitting a form, placing an order, or applying to our ambassador program, you agree to these Terms. If you do not agree, do not use the site or our services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use our website or engage our services. If you are using the site on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. Use of the website

You agree to use powerwyze.com for lawful purposes only. You will not: attempt to interfere with the site’s operation; reverse engineer any code; submit false, misleading, or spam information through any form; scrape the site at a volume that disrupts service; or use the site to harass any person.

3. Quote requests & orders

Submissions through the “Request a quote” form and the RoboKiosk configurator are requests for proposal, not binding orders. A binding agreement is formed only when PowerWyze sends you a written quote or invoice and you accept it in writing (including by email confirmation or signed order form) and the required deposit is paid.

4. Pricing & payment

  • Prices displayed on the website and in the configurator are indicative. Final pricing is set in the written quote.
  • Quotes are valid for 30 days from issuance unless stated otherwise.
  • Unless otherwise agreed in writing, a 50% deposit is required to confirm a rental or purchase order. The remaining balance is due before delivery or deployment.
  • Payments are made via the methods listed on the invoice (ACH, wire, credit card via Stripe, or other agreed method). Credit card surcharges may apply.
  • Late payments accrue interest at the lesser of 1.5% per month or the maximum permitted by law.
  • All prices are in U.S. dollars. Taxes, shipping, and travel are additional unless explicitly included in the quote.

5. Rentals

  • Rental day rates begin at $1,200/day for the 32” RoboKiosk, with larger sizes priced in $500 increments.
  • The rental period covers on-site event days only. Setup, breakdown, and travel days are scheduled separately and may be billed at our discretion based on the activation footprint.
  • You are responsible for providing reasonable on-site conditions: secure indoor placement, standard 110V power within 25 feet, and reasonable physical security overnight. Outdoor placement requires advance approval and may carry additional fees.
  • You are responsible for any loss, theft, or damage to the kiosk and its accessories caused by negligence, attendee misuse, or third parties under your control. We may require a security deposit on bookings over $5,000.
  • Cancellations more than 14 days before the event: full refund of deposit minus reasonable production costs. Cancellations 7–14 days out: 50% of deposit forfeited. Cancellations within 7 days of the event: deposit non-refundable.

6. Purchases

  • RoboKiosk purchase prices start at $3,500 for the 32” model and scale in $1,000 increments by screen size up to the 65” at $7,500. Final pricing is confirmed on the written quote.
  • Title and risk of loss transfer to the customer upon delivery to the address listed on the invoice.
  • Hardware carries a limited 12-month manufacturer warranty against defects in materials and workmanship, beginning on the delivery date. Warranty excludes damage from misuse, accident, modification, power surges, and normal wear.
  • Returns of purchased hardware are not accepted unless the unit arrives damaged or non-functional, in which case we will repair or replace at our option.

7. IT support & software

  • The IT support plan is $1,000 per year, flat, and covers unlimited software updates, remote troubleshooting, and the activation of new apps onto the kiosk over the support term.
  • Year 1 IT support is included free when you bundle the one-time $500 branding service with a purchase.
  • Support is delivered remotely during business hours (9am–6pm ET, Monday–Friday). On-site visits are billed separately at then-current day rates plus travel.
  • Software is licensed, not sold. PowerWyze retains all rights, title, and interest in the kiosk operating software, apps, and any custom builds. The customer receives a non-exclusive, non-transferable license to use the software on the purchased or rented hardware during the active support term.

8. Branding services

  • The $500 one-time branding service covers custom skinning of the kiosk software (color, logo, intro screen, and basic content swaps) for one brand identity.
  • Custom content production (video, photo, copy, 3D assets) beyond the standard branding package is quoted separately.
  • You represent that any logos, images, copy, fonts, or other assets you provide are owned by you or properly licensed for the use you direct, and you grant PowerWyze a license to use them solely to deliver the services.

9. Ambassador program

  • The ambassador program is offered to approved individuals who introduce qualified leads to PowerWyze. Approval is at our discretion.
  • Referral bonus: $200 cash bonus per RoboKiosk rental booking that closes at over $1,500 in revenue to PowerWyze. Paid within 7 business days after the rental clears and the event is delivered.
  • On-site day rate: When your referral converts, you may be invited on-site as part of the activation team and paid an agreed day rate, set when the booking is confirmed. Travel and lodging for confirmed on-site work are reimbursed at reasonable rates pre-approved by PowerWyze.
  • Attribution: Leads are credited to the first ambassador to introduce a given contact who is not already actively engaged with PowerWyze. We will confirm attribution before each discovery call.
  • Conduct: Ambassadors must accurately represent PowerWyze, comply with applicable law (including the FTC endorsement guides and any required #ad disclosures), and refrain from making representations beyond the materials we provide.
  • The program may be modified or terminated at any time on reasonable notice. Bonuses earned on bookings already closed at the time of any change will still be paid.
  • Ambassadors are independent contractors, not employees, and are responsible for their own taxes (you will receive a 1099-NEC if total payouts exceed the applicable IRS threshold in a calendar year).

10. Intellectual property

powerwyze.com and all content on it — including text, graphics, logos, the PowerWyze name and marks, photos, video, kiosk software, and design — are owned by PowerWyze or our licensors and are protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written permission, except for ordinary personal or internal business review.

11. Disclaimers

The website is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the website is provided for general informational purposes and may change without notice.

Service-specific warranties for purchased hardware are limited to the warranty described in Section 6. Except for that warranty and any warranties expressly stated in a signed agreement, we disclaim all other warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, PowerWyze and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the website or our services, even if we have been advised of the possibility of such damages.

Our total cumulative liability for any claim arising out of or relating to these Terms or the services will not exceed the amount you paid to PowerWyze in the 12 months preceding the event giving rise to the claim, or $1,000, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold harmless PowerWyze from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use of the website or services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any content or materials you provide to us.

14. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida for any dispute that is not subject to arbitration.

Any dispute, claim, or controversy arising out of or relating to these Terms or the services that cannot be resolved by good-faith negotiation will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Broward County, Florida. The arbitrator’s decision will be final and binding. Either party may seek injunctive relief in court for intellectual property infringement. You and PowerWyze agree to resolve disputes only on an individual basis, and not as a class, consolidated, or representative action.

15. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. If we make material changes, we will provide reasonable notice (for example, by posting on the website or emailing active customers and ambassadors). Continued use of the website or services after changes take effect constitutes acceptance.
